1. Legal information – Acceptance of the Website Terms and Conditions of Use.

These provisions regulate the use of the website (hereinafter, “the Website”) that Rodriguez Molnar & Associates (hereinafter, “RM&As” or “The Firm”) make available to the Internet Users.

RM&As is an individually owned law Firm managed by Mr. Héctor Rodríguez Molnar (DNI 05392861M) with fiscal address in c/Clavel 38, 28250 Torrelodones, Madrid.E-Mail: firm@rm-as.com.

The use of the Firm’s  Website is free, without any cost to Users other than those resulting from the costs of the services that they may have retained to access and browse over the Internet.  Eventually, RM&As could restrict access to certain sections of the Website only to clients of the Firm.

Access to and/or use of the Website attributes the condition of User of the Website (hereinafter, the ‘User’) and implies acceptance by the User of all the terms and conditions included in this document.

As this Legal Warning Notice may be modified from time to time, the Users are encouraged to consult this section before making use of the Website.

2.         Intellectual Property Rights

All visible contents of the Website, as well as those that are not immediately visible but may be somehow accessible to people with knowledge of Internet technical aspects, such as source code, meta tags and others, are considered – in any event –  the property of the Firm or the property of the third parties with which the Firm may have contracted them. In no event shall it be understood that the Firm granted authorization, license or implied permission to any User on the exploitation rights allowed at any time by current intellectual property legislation in their regard; except in those cases that are strictly necessary to give the User access to the Website.

3. Terms and Conditions of Use of the Website

3.1. General principles

The Website should be used in a normal and correct manner in accordance with the principles that govern Internet browsing and the rules applicable to and arising from this Website.

The User is responsible before the Firm – and before eventually affected third parties as well – for any damages that both the Firm and such third parties may suffer as a result of a breach by User of any of the obligations herein described.

In particular, is expressly forbidden to the User to develop any activity that involves altering the normal use of the Website or which results directly or indirectly in a harmful consequence result for the Firm; in particular, but not limited to, activities which involve attacks on the Website servers or computers and the logical supports used by such servers.

3.2       Prohibitions

It is forbidden to the User, among other unlawful activities, the reproduction, copying, distribution, publication, removal, alteration or modification of the contents, logical supports or  data used in this Website (hereinafter, Contents), be it for commercial or private use, other than in those cases expressly authorized by law or which have been subject to an express agreement between the User and the Firm or, where appropriate, with those third parties that bear intellectual property rights over such contents.

Certain contents of informative or promotional nature may eventually be used in part by the User but always with express reference to the Firm as the source thereof.

3.3       Introduction of links to the Web page

The Internet Users who may want to introduce links from their own websites to the Firm’s Website (the Links) must comply with the conditions listed below, without ignorance thereabout being efficient cause to relieve the User from the liabilities arising from the law and/or from the following restrictions:

a)         The link to be introduced will only link to the home page of the Website and will not be reproduced in any form (links online, copy of the texts, graphics, etc).

b)         It will be in any event forbidden, in accordance with the applicable legislation in effect at any time, to establish frames of any kind that may wrap the Website or enable the visualization of the Contents through Internet addresses different from the Website and, in any case, when they are displayed together with content unrelated to the Website in a way that may induce to error, confusion or deceive Users about the true origin of the service or Contents; or which involves exploiting in any way the professional reputation of the Firm or contravene the regulations in force.

c)         It shall be prohibited to the User to use any logo or trademark of RM&As in the absence of the Firm’s express consent.

d)         No link may contravene the law or link with contents (i) of third parties; (ii) owned by the person concerned; (iii)  that are illegal or contrary to moral and good habits, or (iv) can induce third party  users to consider that RM&As supports or adheres to ideas, statements or expressions, either legal or illegal.

4. Liability

4.1   Information

The contents of the Website of RM&As include only general information and do not imply – nor can the Users construe – that they represent the provision of professional services of any kind. Therefore, Users should refrain from using it as a means of personal, professional or commercial decisions, which will be at their own risk, without RM&As assuming liability for any direct or indirect consequences arising from such decisions.

4.2       On the technical suitability of the Web page.

RM&As adopts all measures conducive to the safety of the traffic reaching its Website. However, given the characteristics of the Internet network, RM&As cannot guarantee nor in any way assure that navigation will be safe. Therefore, the User accesses the Website of RM&As at his/her own risk, without RM&As (i) assuming any obligation as to the safety of the systems of the User, and (ii) assuring that the User shall suffer no damages.

The User is therefore responsible for the adequacy and timely availability of suitable tools to detect and maintain its programs and technical elements free of virus or other harmful elements.

4.3       On the availability of the Website

The maintenance and operation of the Website depends upon the timely provision of services and supplies by third parties, including signal transport over public communications networks. Therefore, RM&As cannot be responsible for the reliability, quality, permanence and proper functioning of such third party elements. Therefore RM &As accepts no liability whatsoever for injuries, damages or any other incident that may affect the User as a result of the suspension, cancellation, interruption or deficiency in the provision of the services required by the Website.

5.         Regulations on the Protection of Personal Data

The data collected through the Website forms will be incorporated into an automated file of personal character placed under the responsibility of RM&As, that will treat them in absolutely confidentiality and with the sole purpose of properly managing the relationship with its customers and promoting the activities of the Firm.

Therefore, RM & As will eliminate, erase and/or block any data proving to be erroneous, incomplete, obsolete or deceiving in accordance with the data protection regulations in force at any time.

By using  or sending information through the Website the User acknowledges and express, full and unconditional acceptance to the principle that any data transmitted by the User will be treated and managed in the above referred manner, by any means  – including electronic ones -, that the Firm can use to contact the User.

The fields marked with an asterisk on the data collection forms are mandatory so that in the event that the User does not provide the corresponding data, RM&As may – at its sole discretion – deny any contact or service.

The User may revoke the consent given and exercise its rights of access, rectification, cancellation and opposition by contacting for the address indicated in the above Section 1.

RM&As applies the security levels that are legally required by Royal Decree 1720 / 2007, of 21 December, which approved the Implementing Regulations to Organic Law 15/1999, of 13 December, on the Protection of Personal Data.

Without prejudice to the above, total technical security cannot be guaranteed and RM&As assumes no responsibility for any intentional actions of third parties that may cause the User any prejudice or damage.

In the use and management of its Website, RM&As can eventually use “tracking cookies” and recommend Users that they internalize such cookies and their operating characteristics in order to take the configuration of their navigation systems that best suit its needs with respect to these Internet tools. RM&As does not guarantee that the chosen configuration will be  the most suitable one to access and browse through its Website.

6.         Communication of Illegal and/or Inappropriate Activities.

Should the User or any other Internet user have knowledge that third-party sites refer to pages which contents or services are unlawful, noxious, degrading, violent or contrary to morality, User is encouraged to make RM&As aware of the following data:

  • The User’s personal data: name, address, telephone number and e-mail address;
  • Description of the facts that reveal the unlawful or inappropriate nature of the third party site or contents;
  • Express statement that the information contained in the communication is truthful and complete up to where the caller can know or understan

The receipt by RM&As of the communication provided for in this paragraph will not mean that RM&As has actual knowledge of the activities and/or contents indicated by the notifying User.
